1. To Enter:
The sweepstakes is open only to Papa Johns Rewards Members. Papa® Rewards membership is available for free signup at: https://www.papajohns.com/order/create-account. Rewards members may enter by visiting https://shaqaronisweeps.papajohns.com, any time between 12:00:01 p.m. ET November 2, 2023 and 11:59:59 p.m. ET November 19, 2023 (“Promotion Period”) and completing and submitting the entry form. After submitting the initial online entry, participants who purchase a Papa Johns Shaq-a-Roni pizza using their Papa Rewards member account during the Promotion Period will earn ten (10) additional entries for each purchase; participants who purchase any Pepsi-Cola® beverage product using their Papa Rewards member account during the Promotion Period will earn one (1) additional entry for each purchase. After submitting the initial online entry, Papa Rewards member participants who wish to earn additional entries without making a purchase may send a standard size postcard, only, with their hand-printed full name, address, phone number, email, and bonus entry level they’d like to earn (“Shaq-a-Roni'' or “Pepsi”) to: Papa Rewards Shaq-a-Roni Sweepstakes, P.O. Box 907, Marblehead, MA 01945. You may enter as often as you wish for bonus entries via mail-in, but each no purchase bonus entry postcard must be mailed separately. Incorrectly or incompletely addressed postcards, oversized postcards, and requests submitted in envelopes will be considered ineligible and will not be acknowledged. Limit one (1) initial entry per person or email address. Entries must be complete and legible to be eligible. Providing an invalid email address, invalid personal information, multiple entries beyond what’s stipulated above, or otherwise failing to abide by these Official Rules will result in Sweepstakes disqualification. In the event of a dispute regarding the identity of any entrant, the entry will be deemed made by the person identified as the authorized account holder of the email address submitted at the time of entry (i.e., the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address). Participants are responsible for determining the corresponding time zone in their respective location for entry. For purposes of the Sweepstakes, the sole determinant of the current time will be the clock on the promotion website server, regardless of what any other timekeeping device might indicate. Online entries must be received 11:59:59 p.m. ET November 19, 2023; mail-in bonus entry postcards must be received by November 25, 2023.
2. Eligibility:
The sweepstakes is open to Papa Johns Papa Rewards members who are legal residents of the United States and Canada (including the Province of Quebec), twenty-one (21) years of age or older at the time of entry. Not open to employees and their families (spouses, parents, children/siblings and their respective spouses, and those living in the same household) of Papa John’s International, Inc., PepsiCo, Inc., Pepsi-Cola Company and its bottlers, Medium Rare Live, LLC, Authentic Brands Group, LLC, ABG-Shaq, LLC, Mine O’ Mine Holdings Inc., ABG-Shaq Entertainment, LLC, Shaquille O’Neal, Wynn Las Vegas, LLC, Knuckle Sandwich, LLC, Guy Fieri, LINQ, LLC, The Law Office of Jeffrey B. Gandel, their subsidiaries, affiliates, participating retailers, franchisees, promotion partners, advertising and production agencies, PROMOSIS, INC. Entrants consent to the use of their registration information in accordance with Papa Johns Papa Rewards Terms and Conditions. Entrants agree to the release of their name, address, and email information to Promosis for winner notification purposes and for public winner disclosure as required by law. Sweepstakes is void where prohibited by law or regulation, and is subject to all applicable U.S. federal, state, and local laws and regulations.
3. Drawings:
Winners will be selected via random drawings on or about November 28, 2023, from among all eligible entries received. Drawings will be conducted by PROMOSIS, INC. (“Administrator”), an independent judging organization whose decisions in all matters relating to this sweepstakes are final. Potential winners will be notified by email, and will be required to complete an online verification form within three (3) days of the date and time the initial notification is sent to the potential winner, or prize may be forfeited, and an alternate winner randomly selected from the remaining pool of participants received for the original drawing. Potential winners who are residents of Canada will be required to correctly answer a skill-testing question to be eligible for prize award, in accordance with Canadian law. Any potential winner who fails to respond to the winner notification or is found to be ineligible will be disqualified, and an alternate winner will be randomly selected from the remaining pool of participants received for the original drawing.
4. Prizes:
One (1) “Gold” Grand Prize: a trip for two (2) to Las Vegas, NV, including round trip Economy Class/Main Cabin air travel from the major gateway airport nearest the winner’s home, three (3) nights lodging (1 room, double occupancy) at Conrad Las Vegas Resorts World®, ground transportation to and from the airport in Las Vegas, two (2) VIP tickets to Shaq’s Fun House and Guy’s Flavortown Tailgate, an exclusive meet and greet with Shaquille O’Neal with the opportunity to join Shaq on the mainstage during his evening DJ set, signed Shaquille O’Neal memorabilia, event merchandise, plus a $250 Papa Johns® Gift Card and Pepsi® 54 qt. hard-sided cooler. Approximate retail value of Grand Prize = US$12,500. Actual value may vary based on timing of trip, location of departure city, and assessment of prize elements publicly available. Difference between actual value and stated value, if any, will not be awarded in cash or other consideration. Grand Prize components, including opportunity to meet Shaquille O’Neal, are subject to scheduling, availability, and certain other restrictions.
Six (6) “Silver” First Prizes: a Shaquille O’Neal signed basketball, a $150 Papa Johns® Gift Card, exclusive Shaq-a-Roni merchandise, and a Pepsi® Big Chill cooler bag. Approximate retail of each First Prize = US$570.
Fifteen (15) “Bronze” Second Prizes: a Shaquille O’Neal signed Papa Johns® pizza box, a $100 Papa Johns® Gift Card, and a Pepsi® 40 oz. stainless steel tumbler. Approximate retail value of each Second Prize = US$165.
Prizes may not be transferred or redeemed for cash, in whole or in part. Winners are solely responsible for all applicable taxes on the value of the prize won. Grand Prize winner (if a US resident) will be required to provide their Social Security number, to be issued an IRS 1099-MISC tax form for the retail value of the prize won. Grand Prize winner will also be required to upload a “selfie” photo and an image of a government-issued photo ID, as part of online verification. Grand Prize elements, including air travel provider and hotel, will be chosen by Administrator. Grand Prize winner is responsible for any incidental travel costs not expressly stated above, including but not limited to transportation to/from airport in departure city, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, meals, personal charges at lodging, or other expenses. Any other costs associated with the Grand Prize trip are at the winner’s discretion, and are not included. Grand Prize trip will be scheduled for February 9-12, 2024 (2/9/24 departure, 2/12/24 return). Grand Prize winner and guest must be available to travel on the dates specified by Sponsor, or prize and its value will be forfeited. Trip guest of the Grand Prize winner must be twenty-one (21) years of age or older, and will be required to complete a liability/publicity release (where permitted by law) before trip is booked. Winner and guest must travel together on the same itinerary, and are solely responsible for obtaining any and all required travel documentation. Prize trip and its components are subject to scheduling availability and certain other restrictions. Sponsor and Administrator and/or any party related to Sponsor and Administrator, including, but not limited to, Medium Rare Live, LLC will not be responsible for replacement of any lost or stolen game tickets once they are in winner's possession or in the possession of the winner’s guest. Shaq’s Fun House and Guy’s Flavortown Tailgate tickets are subject to the terms and conditions specified by the respective venue. Winner and guest must comply with all Shaq’s Fun House and Guy’s Flavortown Tailgate venue regulations and agree to all venue policies, or that portion of the prize may be forfeited. Sponsor and Administrator and/or any party related to Sponsor and Administrator, including, but not limited to, Medium Rare Live, LLC, are not responsible for any postponement, delays, or cancellation of air travel in connection with the prize trip or any postponement, delays, or cancellation of any prize-related events, due to COVID-19 or other reasons. Gift Card prizes are subject to Papa Johns® Gift Card Terms and Conditions.
No substitution for prizes or parts thereof, except by Sponsor as may be due to unavailability. If originally-offered prize or any prize element is unavailable at the time of award, Sponsor may substitute an item of comparable or additional value. By accepting a prize, winner agrees to grant to the Sponsor and its promotion partners the right without limitation to use the winner’s name, picture, portrait or likeness, and voice in any future promotional material connected with this sweepstakes in any and all media, now known or hereafter devised, without further compensation, where permitted, and that such use can be made without prior inspection or approval of the use of any copy used in connection with it. Limit one (1) prize per person. No more than the stated number of prizes will be awarded. Odds of winning a prize are dependent upon the total number of entries received by the deadline.
5. Limitation of Liability:
Sponsor, Medium Rare Live, LLC, Authentic Brands Group, LLC, ABG-Shaq, LLC, Mine O’ Mine Holdings Inc., ABG-Shaq Entertainment, LLC, Shaquille O’Neal, Wynn Las Vegas, LLC, Knuckle Sandwich, LLC, Guy Fieri, LINQ, LLC, and their promotion partners, independent judging organization, and their affiliates are not responsible for typographical errors in any sweepstakes-related materials; for lost, late, misdirected, or incomplete registrations/entries or email; for technical, hardware, software, Internet, or telephone failures of any kind; for lost or unavailable network connections; for viruses; or for failed, incomplete, garbled, or delayed computer transmissions that may limit or interfere with a participant’s ability to take part in the promotion. Entries generated by script, macro, or other automated entry devices are not valid and will be disqualified. Sponsor reserves the right to disqualify and seek prosecution of any entrant who disrupts or interferes with the proper play of the sweepstakes, or acts in violation these Official Rules in any way. Sponsor reserves the right to cancel or modify promotion if fraud or technical failure compromises the integrity of the promotion, or corrupts or impairs the administration, security, fairness, or proper play of the sweepstakes, as determined by Sponsor in its sole discretion. 6. Dispute Resolution:
THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Massachusetts having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participants' actual out-of-pocket expenses (i.e., costs associated with entering this sweepstakes), and participant further waives all rights to have damages multiplied or increased.
